(For Unload – Logistics Platform)
1.Definitions
Platform: Mobile app, website, and systems operated by Unload
Company: Unload including its team and affiliates
User: Drivers, Truck Owners, Suppliers, Traders, Manufacturers, Consignors, Consignees
Services: Logistics facilitation, booking, tracking
2.Acceptance of Terms
By using the Platform, you agree to these Terms, Privacy Policy, and applicable laws.
If you do not agree, do not use the Platform.
3.Nature of Platform
The Platform acts as an intermediary/aggregator.
- Does NOT own vehicles
- Does NOT provide transport services
- Does NOT take custody of goods
All contracts are between Users.
4.Applicable Law
- Motor Vehicles Act, 1988
- Information Technology Act, 2000
- Digital Personal Data Protection Act, 2023
- Consumer Protection Act, 2019
- GST Laws
5.User Eligibility
User must be legally competent to contract.
6.User Obligations
Driver:
- Valid driving license
- Safe and lawful conduct
Truck Owner:
- Valid documents & insurance
- Maintain vehicle condition
Supplier/Trader:
- Accurate shipment details
- Legal goods & documentation
7.Prohibited Activities
- Illegal goods transport
- Fraud or misrepresentation
- Unlawful use
8.Payments & Fees
- Platform fees, commission, service charges
- Payments via UPI, bank transfer, gateway
The Platform is only a payment facilitator and not liable for disputes.
9.Documentation
- GST compliance
- E-way bills
- Transport documents
10.Insurance
The Platform may facilitate third-party insurance but is not liable for claims.
11.Limitation of Liability
- Loss/damage of goods
- Delays
- Accidents
12.Indemnity
User agrees to indemnify the Company against claims and damages.
13.Suspension & Termination
Accounts may be suspended for violations.
14.Force Majeure
- Natural disasters
- Government restrictions
- Network failures
15.Dispute Resolution
Negotiation → Arbitration (India law)
Venue: Cuttack, Odisha
16.Jurisdiction
Courts in Cuttack, Odisha shall have exclusive jurisdiction.
